Your arguing something I never said in the first place. Where did I say anything about them not being allowed to do it?
I didn't.
Technically the terms of some software would "allow" them to legally erase your hard drive. Doesn't mean they should or will.
In any case, I'm pretty sure that unless you agree to the terms of the contract at the time of sale, then you are not bound to any of the terms set forth in the EULA, unless they are already covered by an existing law.
